Concerning the visa

When you have a permanent Australian business visa, you can fly to and from Australia as many times as you wish for the next five years. This duration of travel validity is referred to as a travel facility. You will not be eligible to return to Australia as a permanent resident if your original 5-year travel permit expires and you are outside of Australia. This Resident Return Visa allows you to return to Australia.

Eligibility

  • When you apply for the visa, you can be in or out of Australia, but you cannot be in immigration clearance.
  • If you apply on paper in Australia, you must mail your application to the provided address. You are unable to apply in person.
  • You must be an Australian permanent resident, a former Australian permanent resident whose last permanent Australian business visa or Employer Sponsored Visa was not terminated, or a former Australian citizen who lost or renounced citizenship.
  • You must meet the conditions for residence or substantial ties. To achieve these conditions, you must either: have resided in Australia for two years (730 days) in the last five years as the owner of a permanent visa (or entry permit), or be an Australian citizen with substantial ties to Australia that benefit Australia. Business links, cultural ties, employment ties, and personal relationships are all examples of significant ties.
  • There are no minimum or maximum ages for RRV applicants
  • You are not eligible for this visa if you have: Return Endorsement (given between March 1, 1976 and August 31, 1979) (issued between 1 September 1979 and 31 December 1986)

Visa Advantages

Validity of travel facilities and residency requirements

  • Your RRV has a 5-year travel validity period.
  • To qualify for the 5 year RRV, you must have resided in Australia for two years (730 days) in the previous five years as a legal resident, former citizen, or former permanent resident.
  • If you do not meet the residence requirement, that is, if you have not lived in Australia for two years in the last five years as a permanent resident, former citizen, or former permanent resident, you may be granted a maximum of 12 months travel validity on your Australian business visa if you can demonstrate substantial ties that benefit Australia. Your relationships must be substantial and beneficial to Australia, and they can include business, cultural, employment, or personal ties.
  • If you fulfill the criteria only because you are a member of the family unit of someone who holds this visa, your visa will only be valid for a maximum of 12 months.

Visa subclasses that may be applicable to you

The visa subclass you may be granted is determined by the information you supply when you apply.

Visa subclass 155

If you meet the following criteria, you may be given a subclass 155 visa:

  • fulfill the residency requirement (5 year travel facility)
  • have beneficial relations to Australia (1 year travel facility)
  • are a family member of someone who has a Resident Return visa or has applied for one and meets the conditions for grant (up to 1 year travel facility).

Visa subclass 157

If you meet all of the following requirements, you may be awarded a subclass 157 visa:

  • you spent at least one day but no more than two years in Australia in the five years before your application for this visa, and you were an Australian legal citizen or an Australian citizen the entire period you were in Australia
  • There is a strong and humanitarian cause to leave Australia.

Wrapping Up

If you are already a permanent resident of Australia and do not intend to travel, you do not need to register for this visa. There are no restrictions on how many Resident Return visas you can apply for. You are not permitted to include relatives in your application.
